This is where you can find a copy of our contracts. Contracts are subject to change at anytime, but a current contract will be provided prior to any agreement being made and will be honored once completed.

    • (c) The Buyer fails to communicate or make further arrangements concerning the purchase or pick up of a puppy from Okanogan Rottweilers.

  • In any listed event, the Seller shall be free to sell the puppy to another party.

  • In the event that the puppy is not available due to sickness, death, or any other circumstance owing to the fault of the Seller, the Buyer’s non-refundable deposit will be applied to another puppy of the same gender from the same litter, if available, or the Buyer can make a selection with the same pick order number from the next available litter. 

  • In the event that the Buyer declines the next available puppy offered, the deposit is also forfeit.

  • In the event that the Dog is made available by the Seller and the Buyer does not retrieve the Dog from the Seller on the designated delivery date, a boarding fee of $25 per day will be charged for each day the Dog is boarded by the Seller past the agreed delivery date. 

  • After 24 hours, if no further arrangements have been made and the boarding fee paid, the Seller reserves the right to find another buyer for the Dog and the Seller’s Deposit is forfeit. 


Payments are only accepted via cash, Zelle® transfer, or via CashApp® transfer. Any fees associated with processing any payment is to be covered by the Buyer and all funds must be cleared in the Seller’s account before the Dog is released. All electronic payments are to be made no more than 3 business days prior to the date of delivery. No refund will ever be issued at any time or for any reason.

Sales Contract

SALES CONTRACT FOR ROTTWEILER PUPPY


TERMS AND CONDITIONS


1. Deposit, Payment of Purchase Price, Fees 


If the Dog is being shipped or delivered to the Buyer, all deposits, payments and fees must be paid in full and cleared in the Seller’s account before the Dog is released from Seller’s care.

  • Purchase Price: The non negotiable price for the Dog is $___________.

  • ____ Deposit: The Buyer has paid a non refundable deposit of $_________, with payment of the balance of $__________ due upon release of the Dog to the Buyer. 

  • The Buyer acknowledges and agrees that the Buyer will forfeit the deposit and any rights to the Dog if:

  • (a) The Buyer fails to complete the purchase of the Dog for any reason, 

  • (b) The Buyer fails to pay the balance of the Purchase Price on or within 24 hours of the agreed delivery date stated in this contract.

  • (c) The Seller neglects to retrieve the Dog from the Seller within 24 hours of the agreed delivery date without further arrangements being made and boarding fees being paid.

  • In any of these events, the Seller shall be free to sell the Dog to another party and the Seller’s deposit shall be forfeit. 

  • In the event that the Dog is not available due to sickness, death, or any other circumstance owing to the fault of the Seller, the Buyer’s deposit will be applied to another dog from the same litter, if available, or the Buyer can make a selection from the next available litter.

2. Transfer of Ownership and Registration Requirements


  • Upon payment in full of the Purchase Price, the Seller shall promptly take all actions required to officially transfer ownership and registration of the Dog to the Buyer.

  • All Dogs sold by Okanogan Rottweilers are of the highest quality and each is sold with either Full registration or Limited registration as listed.

  • The Dog is being sold with:

    • ____ Full Registration: All breeding and show rights are provided with the sale of the Dog. Full registration paperwork will be provided by the Seller with the Dog on the delivery date.

    • ____ Limited Registration: The Dog is sold with limited registration. The Dog is sold as a pet only. The Dog WILL NOT be permitted to produce offspring. 

      • In the event that the Dog is found to have produced offspring, violating the terms of this agreement, the Buyer will be held financially accountable for the cost of changing the AKC registration paperwork. The Buyer will pay a $1500 fee for the registration papers and penalty of $500 for violating the terms of this agreement.

  • The Buyer will choose the Dog's “Call Name” but the Dog will permanently carry the Okanogan Rottweilers Kennel name as a surname on the AKC Registration and any other registration or licensing, foreign or domestic, applied to the Dog.

  • The Buyer agrees to apply “Von Okanogan Rottweilers” as the surname to their dog’s name when completing registration with the AKC.

  • The Buyer agrees to pay any additional cost to add the required surname to the registration form.

  • The Buyer agrees to Register the Dog within 3 business days of the receipt of the registration form, provided by the Seller upon purchase.

  • The Buyer agrees to register the Dog’s microchip with AKC Reunite® and pay any associated fees at the time of AKC registration.

3. Seller’s Representations and Warranties 


Representations: 


  • The Seller represents to the Buyer that: 

  • The Seller is the legal and true owner of the Dog and that the Seller has full right and authority to sell the Dog. 

  • The Dog is being sold free and clear of any lien, security interest, charge or other encumbrance.

  • The Seller guarantees that the Dog is a purebred Rottweiler, offspring of the purebred sire and purebred dam set out on the Bill of Sale accompanying this agreement. 


Health Warranty: 


  • The Seller offers a 5 year health warranty against any veterinarian diagnosed and documented genetic disorder including but not limited to, heart murmur, hip, shoulder or elbow dysplasia, JLPP, MMM or IBD. The litter date of birth is the start date for the 5 year health warranty.

  • The Seller guarantees that the Dog is in good health and free of communicable diseases on the date of delivery and will provide a signed health certificate from a licensed veterinarian. 

  • The Buyer has 10 business days from the delivery date to have the Dog examined by a licensed veterinarian, at the Buyer’s sole cost. If the Dog is found to be ill or otherwise unfit in any way during the examination, the Buyer must notify the Seller immediately and provide a written statement and all medical records from the veterinarian. Failure by the Buyer to have the Dog examined within the 10 day period will nullify this warranty.

  • If the Buyer chooses to keep the Dog, no replacement will be given and all medical costs and treatment are the sole responsibility of the Buyer. This health guarantee will be null and void at that time. 

  • If the Buyer chooses NOT to keep the Dog, the Buyer will return the Dog to the Seller within 24 hours of the veterinarian visit with all documentation from the veterinarian and a replacement will be offered from the Seller. The replacement Dog will be from either the same litter, if available, or from the next litter as availability allows at the Seller’s sole discretion. A new contract will be drawn up at that time and this contract will be void.

  • This Warranty does NOT cover Cherry eye, Entropion, Ectropion, Allergies, undescended testicles, Stenotic nares, elongated soft palate, umbilical hernia, dermatitis, demodectic or sarcoptic mange, or any communicable disease contracted after leaving the Seller's care. 

  • The Seller will NOT replace a puppy due to heat stroke, abuse/neglect, or improper socialization or training.

  • To ensure that the Buyer does not euthanize the Dog or take it to an animal shelter, the Seller agrees to take the Dog back at any time during the Dog’s lifetime for any reason.

  • In the event that the Dog is returned to the Seller no other Dog will be provided to the Buyer unless;

  • the Dog’s return was a result of a veterinarian evaluation with respect to the Dog’s health within the 10 day veterinarian visit requirement and full documentation is provided.​​

OR

  • the Dog is younger than 5 (five) years of age and presents with a genetic health defect and the Buyer can provide a full history and documentation of veterinarian care and diagnoses from the Dog’s entire life. 

  • In the event that the Dog is found to have a genetic health defect within the 5 year warranty period and is proven via veterinarian documentation, the Seller will provide a puppy of equal value. The Dog will be returned to the Seller with all veterinarian documentation and a signed release of information for the Buyer’s veterinarian’s office concerning the Dog before a new puppy will be provided. The new puppy of equal value will be made available based on the Seller’s discretion and availability.

  • No refund will ever be issued for any reason.

  • This warranty DOES NOT cover cancer of any kind, as the causes of cancer are not expressly genetic in origin.​

  • This warranty DOES NOT cover any hip, shoulder or elbow dysplasia caused by undue stress to those joints by any injury, extreme overwork, overexertion, over exercise or careless maintenance of the Dog as determined by the Seller’s licensed veterinarian.

  • This warranty covers only the original Buyer and is not transferable to any new owner not listed in this agreement at the time of purchase.

4. Fitness of Purpose 


The Dog was bred to fill multiple roles as the Rottweiler is a multipurpose breed. The Rottweiler is suited for work in protection and security, as a personal companion animal, as a family pet, as a show prospect or as a general working dog. Just like people, the Rottweiler temperament can vary from individual to individual. It is the responsibility of the Buyer to fully research the potential behavior and personality traits the Rottweiler breed may possess.

  • The Buyer acknowledges that the Dog has potential in each of the roles the Rottweiler was bred for contingent on proper training, socialization, nutrition, healthcare and environment. 

  • The Buyer acknowledges that the Seller does not provide any guarantee as to the Dog’s fitness for any specific purpose, including but not limited to protection work, obedience trials, show ring performance, and/or breeding purposes. 

  • The Buyer acknowledges that the Seller does not guarantee any specific personality traits, behaviors or trainability for an individual Dog. 

  • The Seller provides early neurological stimulation, temperament evaluations and puppy culture environment during the time they are in the Seller’s care. Each Dog is an individual and is shaped by their environment, diet, socialization, and training. 

  • The Buyer acknowledges that shaping the personality, controlling the behavior, and providing training and socialization of the Dog are all the sole responsibility of the Buyer once the Dog leaves the Seller’s care.


5. Buyer’s Representations 


The Buyer represents to The Seller that: 

  • The Buyer agrees that they have thoroughly researched the Rottweiler breed, and understand any behavior and health issues they can possess.

  • The Buyer understands that they are solely responsible for all medical costs of their puppy. No refunds for medical bills will be given for any reason. 

  • The Dog will reside with the Buyer and the Buyer’s family regardless of the intended purpose of the Dog.

  • The Buyer agrees to keep the Dog in an enclosed area of adequate size, and will not allow the Dog to roam at will. 

  • The Buyer agrees to not keep the Dog permanently chained, tethered or housed in an outdoor kennel or dog house, without proper care and socialization. 

  • The Buyer agrees to provide the Dog with nutritious food and keep the Dog at a healthy weight per the veterinarian recommendation.

  • The buyer agrees to provide all necessary veterinary care, including deworming, heartworm prevention and regular vaccinations, including rabies as the veterinarian recommends. 

  • The Buyer agrees to take the Dog to a licensed veterinarian within 10 business days from the delivery date to have the Dog examined at the Buyer’s sole cost.

  • The Buyer agrees to notify the Seller immediately and provide a written statement and medical records from the veterinarian in the event of any negative findings during the exam.

  • The Buyer affirms they are not acting as an agent for any other person or business in the purchase of the Dog. 

  • The Buyer agrees to not sell, give, or release the Dog to an animal shelter, pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility. 

  • In the event that the Buyer sells the Dog to a new owner, the Buyer shall ensure that the new owner agrees in writing to comply with the terms of this contract. 

  • In the event that ownership of the Dog is transferred, the Buyer agrees to notify the Seller in writing and provide the full name, address, phone number, and email address of the new owner to the Seller immediately upon the transfer of ownership from the Buyer.


6. Indemnity and Release 


  • If any action or failure to act on the part of the Buyer shall result in any claim, suit, loss, damage, injury, death, or liability to the Seller, then the Buyer agrees to defend, indemnify, and hold the Seller harmless and to pay all of the Seller’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto. 

  • The Buyer releases the Seller from any and all liability, costs or damages caused by the Dog after placement with the Buyer, including but not limited to damage to or destruction of property, and personal injury to any person.


7. Limitation of Action

Any action or claim brought by the Buyer against the Seller for breach of this contract or for loss due to negligence must be brought within 1 year of the date this contract was signed. 

Any action or claim brought by the Seller against the Buyer for breach of this contract or for loss due to negligence may be brought anytime after the date this contract was signed. 


8. Governing Laws

This contract shall be governed by and construed in accordance with the laws of the United States. 


9. Entire Contract 

This contract represents the entire agreement by and between the listed parties on the Bill of Sale of this contract. The Seller and the Buyer have made no other agreements, promises, representations or warranties, expressed or implied, unless specifically stated in this contract.

This contract is entered into by Stud Dog (male dog) Owner, Kanga McCrarey and the Dam (female dog) Owner, __________________________________, (today’s date) _____________.

STUD FEE (check one)

  • To be paid in full before Breeding occurs.


  • First choice pick puppy Male or Female, to be determined by Stud Dog Owner.


The Stud fee is $1,500.00 for any stud from the Okanogan Rottweiler kennel. 

Litter registration papers will not be signed unless Stud Fee and any associated veterinary or other agreed upon expenses are paid in full.

OTHER CONSIDERATIONS  

  • If the Stud Dog Owner chooses to take a puppy in lieu of a Stud Fee, the Stud Dog Owner will pre-select a puppy at 6 weeks of age from the sired litter, after an examination of the entire litter. The final selection of a puppy will be made at 8 weeks, before any puppies from the sired litter have left the Dam Owner’s residence. 

  • The puppy will carry a name chosen by the Stud Dog Owner. 


DEFINITION OF “LITTER”  

A Litter, for the purposes of this Contract, is defined as a minimum of 1 puppy born alive. If Breeding does not produce offspring, a Repeat Breeding will be given to the same Dam in her next season (heat cycle). If the Dam fails to conceive on the return service, this Contract is terminated. If other arrangements have not been made with the Stud Dog Owner and the Dam is not bred on her next season (heat cycle), or is bred to another stud dog on her next season (heat cycle), this Contract is null and void and the Stud Fee is forfeit. 

IN THE EVENT OF ONLY 1 (ONE) PUPPY

  • If Litter results in only one puppy, the Stud Fee will be considered payment for a one puppy Litter and the Contract is fulfilled. 

  • In the event that the Litter results in only one puppy, and per the agreement, the Stud Dog Owner is taking a first choice pick puppy in lieu of a Stud Fee, the puppy will be given to the Stud Dog Owner and the Contract is fulfilled. 

  • The Stud Dog Owner can also choose to request the original Stud Fee of $1000.00 if the puppy is unwanted by the Stud Dog Owner for any reason.

Stud Fee must be paid in full before the Dam is returned to the Dam Owner after any Breeding. Except where a puppy is to be taken in lieu of the Stud Fee. 

STUD DOG OWNER AGREES TO:  

  • Provide a three-generation pedigree of the above-named Stud Dog;  

  • Provide copies of any health clearances or testing results that have been performed on the Stud Dog;  

  • Provide documentation of a current clear Brucellosis screening;  

  • Take proper care of the Dam while in Stud Dog Owner’s charge;  

  • Sign Litter Registration promptly upon payment in full of Stud Fee and any other outstanding balance related to this Breeding.  

DAM OWNER AGREES TO:  

  • Pay the agreed Stud Fee before the Dam is serviced; OR Provide pictures, video or other media of the puppies in Litter resulting from this Breeding for the Stud Dog Owner to begin the screening and selection process in the event of a pick of the litter Stud Fee option;

  • Provide a three-generation pedigree of the Dam to be bred;  

  • Provide a copy of the AKC registration certificate with full status listed

  • Provide copies of any health clearances or testing results that have been performed on the Dam to be bred;  

  • Provide documentation of a current clear Brucellosis screening;  

  • Provide documentation of a clear vaginal culture. This is to protect both the Stud and the Dam. Further it is suggested that the culture be done far enough in advance to allow treatment of any problems with antibiotics before the Breeding. While in care of the Stud Dog Owner, a culture or veterinary examination may be required at the Dam Owner’s expense if there is any suspicion of a problem. Dam Owner shall be liable for any loss of Stud Dog’s future services due to Dam Owner’s concealment of health problems;  

  • Send the Dam in good health, free of parasites or infections, and in season (heat);

  • Notify Stud Dog Owner in writing, no later than 70 days after Breeding, if no pregnancy results from the mating. Failure to do so will result in no return service being provided; 

  • Keep the Bitch properly confined following Breeding to ensure no other Dog could mate  her accidentally before her season is complete;  

  • Agrees to not knowingly sell or transfer puppies resulting from this Breeding to any person or firm connected with the business of resale or wholesale of dogs.

  • Pay any and all veterinary and financial arrangements, including, but not limited to traveling expenses, emergency vet care related to this Breeding, etc.  

OTHER AGREEMENTS  

  • The Dam Owner is responsible for all testing done to the bitch prior to and during Breeding to assure the proper timing of said Breeding. 

  • If the Stud Dog is able to perform naturally and for some reason the Dam Owner asks for artificial insemination or the Dam cannot be bred naturally, the Dam Owner is responsible for the cost of said process. 

  • If the Dam Owner is not willing or able to pay for progesterone testing, smears or AI's this should be stated ahead of time, included in the contract and initialed by both parties. If this is the case we will try our best to breed the dogs at the proper time but if no puppies result the deposit is forfeited and no repeat breeding is offered. 

  • The cost of shipping the Dam to and from the Stud dog is that of the Dam Owner. The Stud Dog Owner does not charge a boarding fee or pick up and delivery charge unless Dam must stay for a longer period of time than what is usually necessary (7 days) or if the Stud Dog Owner must travel over 10 miles to pick up the Dam. 

  • The Dam Owner is responsible for the cost of Dam’s food, supplements and any necessary medication while in the care of the Stud Dog Owner. 

  • The Dam will be treated like one of the Stud Dog Owner’s own animals when in the care of the Stud Dog Owner. The Dam will be kept inside in the Stud Dog Owner’s home during her stay. She will be exercised, played with and pampered. Stud Dog Owner will make his/her greatest effort to make sure this Dam will feel comfortable during her stay, as well as being adequately separated from Stud Dog Owner’s other male dogs. 

  • The Dam will be bred two to three times naturally while in the Stud Dog Owner’s care to cover the entire breeding cycle. We will make every effort to  cover the entire breeding cycle of the Dam. 

  • No puppies resulting from the breeding may be sold to brokers, pet shops or puppy mills. Should this part of the contract be ignored, the Stud Dog Owner will pursue this clause in a court of law. Further, Stud Dog Owner requires that no puppies sired by this Stud Dog are sold outside the United States unless expressed permission is given in writing by the same. 

  • By this Contract, it is specifically agreed that the Stud Dog Owner is not obligated to sign the application for Litter Registration until, and unless, the Stud Fee and any other related financial arrangements have been paid in full, or, in the case of a puppy-back agreement (in lieu of Stud Fee), the Stud Dog Owner has taken possession of the puppy as previously agreed.

I understand the above written Contract and agree to abide by all sections both typed and written.  Both parties agree to all of the above agreements and terms.
